M8tcha Terms of Service
Last Updated: September 15, 2026
These Terms of Service ("Terms") are a legal agreement and End-User License Agreement ("EULA") between you (the "End-User") and M8tcha, Inc. ("M8tcha," "we," "us," "our") governing your use of the M8tcha: Find Your People mobile application (the "Licensed Application" when obtained from the Apple App Store) and related websites and services (collectively, the "App"). This EULA is concluded between you and M8tcha only, and not with Apple Inc. ("Apple"). M8tcha, not Apple, is solely responsible for the App and its content. By creating an account or using the App, you agree to these Terms and our Privacy Policy, Acceptable Use Policy, and Refund Policy. If you do not agree, do not use the App.
These Terms are intended for users in the United States and elsewhere. If you are a consumer in the EU/EEA or UK, mandatory consumer protections of your country of residence also apply and prevail over conflicting terms to the extent required by law.
1. Eligibility
You must be at least 18 years old to use M8tcha. By using the App, you represent and warrant that:
- You are at least 18 years old and legally able to enter a binding contract;
- You are not barred from using the App under the laws of your jurisdiction;
- You are not a convicted sex offender, and are not using the App to harass, exploit, or harm others;
- All registration information you provide is accurate, current, and complete.
We may require age or identity verification at any time and may suspend or terminate accounts that violate this section. The App is not intended for children under 13 and is not directed to users under 18.
2. Your Account
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- One person may maintain only one account. Impersonation, fake profiles, and bots are prohibited.
- You must notify us immediately at [email protected] of any unauthorized use of your account.
3. The Service
M8tcha is a social/dating platform that helps users discover and connect with other users based on profile information, preferences, and location. M8tcha does not conduct criminal background checks, identity verification, or screening of any kind on users, unless explicitly stated otherwise in-app. You are solely responsible for your interactions with other users, on and off the platform.
Safety Disclaimer
We strongly encourage you to:
- Meet in public places for initial in-person meetings;
- Tell a friend or family member where you are going;
- Never send money, gift cards, or financial information to anyone you meet on M8tcha;
- Report any suspicious, abusive, or inappropriate behavior immediately via the in-app report tool.
M8tcha is not responsible for the conduct of any user, online or offline.
4. User Content & License
"User Content" means any photos, videos, profile information, messages, or other material you submit to the App.
- You retain ownership of your User Content.
- By submitting User Content, you grant M8tcha a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, and distribute it solely for the purpose of operating, promoting, and improving the App (e.g., displaying your profile to other users).
- You represent that you own or have the necessary rights to all User Content you submit, and that it does not infringe any third party's rights.
- We may remove any User Content that violates these Terms or applicable law, at our discretion.
Prohibited Content & Conduct
You may not use M8tcha to:
- Post content that is sexually explicit, exploits minors, is violent, hateful, harassing, or discriminatory;
- Impersonate any person or entity, or misrepresent your identity, age, or affiliation;
- Solicit money, engage in scams, or promote commercial activity, including sex work solicitation;
- Harass, stalk, threaten, or intimidate other users;
- Upload malware, spam, or attempt to scrape, reverse-engineer, or interfere with the App;
- Violate any applicable law or third-party right.
We may investigate and take appropriate action - including content removal, warnings, suspension, or termination, and reporting to law enforcement - against anyone who violates this section. See our Acceptable Use Policy for the full enforcement and reporting process.
5. Reporting & Blocking
You can block or report any user directly within the App. We review reports and take action consistent with our Community Guidelines and applicable law, though we cannot guarantee any particular outcome or response time.
6. Subscriptions, Auto-Renewal & In-App Purchases
If M8tcha offers paid subscriptions or in-app purchases ("Paid Features"):
Current plan intervals and prices are listed on our Pricing page. The offer and total shown at checkout control the transaction.
- Payments may be processed through Apple's In-App Purchase system, Google Play Billing, and/or Stripe, and are subject to the applicable platform's terms and payment methods. M8tcha does not receive or store full payment card numbers when you pay through Apple or Google Play.
- Auto-renewal: Subscriptions automatically renew at the then-current price for the same billing period unless you cancel at least 24 hours before the end of the current period (or by the deadline stated by the billing platform). By purchasing, you authorize recurring charges until you cancel.
- How to cancel (U.S. / platform requirements):
- Apple: iOS Settings > [Your Name] > Subscriptions
- Google Play: Play Store > profile > Payments & subscriptions
- Stripe / card billing: use the in-app manage subscription / customer portal flow
- Prices are displayed in the App before purchase, may vary by region/storefront, and may change with notice as permitted by law and platform rules.
- Refunds: Apple purchases are handled by Apple (reportaproblem.apple.com). Google Play refunds follow Google's policies. Stripe/card refunds follow our and Stripe's policies and applicable law. Nothing in these Terms limits non-waivable statutory refund or cooling-off rights.
For California and other U.S. states with automatic renewal laws, we present clear pre-purchase disclosures of the offer terms, renewal mechanics, and cancellation instructions, and we obtain your affirmative consent to the automatic renewal where required.
EU/UK Right of Withdrawal
If you are a consumer in the EU/EEA or UK, you generally have a 14-day right of withdrawal from a digital content/service purchase under the Consumer Rights Directive (EU) 2011/83. By purchasing a subscription or Paid Feature and choosing to access it immediately, you expressly consent to immediate performance and acknowledge that you lose your right of withdrawal once the service has begun, to the extent permitted by applicable law.
7. Communications
By creating an account, you consent to receive service-related electronic communications (security alerts, receipts, Terms/Privacy updates, and similar transactional messages). Where required by law (including the U.S. CAN-SPAM Act and TCPA), we will obtain additional consent before sending marketing emails or marketing SMS. You may opt out of marketing emails via the unsubscribe link and marketing SMS by replying STOP. Opting out of marketing does not stop transactional messages needed to operate your account.
8. Intellectual Property
The App, including its design, features, logos, and trademarks (excluding User Content), is owned by M8tcha, Inc. and protected by intellectual property laws. Subject to your compliance with these Terms, M8tcha grants you a limited, revocable, non-exclusive, non-transferable license to download and use the App for your personal, non-commercial use on devices you own or control. This license does not transfer ownership of the App to you. You may not copy, modify, distribute, or create derivative works from the App without our written permission, except as expressly permitted by these Terms or by the Usage Rules in the Apple Media Services Terms and Conditions (including Family Sharing or volume purchasing, where applicable).
Copyright Complaints (DMCA)
If you believe content on M8tcha infringes your copyright, send a notice to [email protected] including: identification of the work, the infringing material's location, your contact information, a good-faith statement of infringement, and a statement of accuracy under penalty of perjury, consistent with the Digital Millennium Copyright Act (17 U.S.C. §512).
9. Termination
- You may delete your account at any time via Profile > Edit Profile > Delete Account.
- We may suspend or terminate your account, with or without notice, if you violate these Terms, pose a safety risk, or for any other reason at our reasonable discretion, subject to applicable law.
- Upon termination, your right to use the App ceases immediately. Paid subscription periods may continue until the end of the then-current term depending on the billing platform's rules. Sections that by their nature should survive (e.g., Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law) will survive termination.
10. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT WARRANT THE ACCURACY, RELIABILITY, OR SAFETY OF ANY USER OR USER CONTENT.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for gross negligence, willful misconduct, fraud, or death/personal injury where such limitation is prohibited, and consumers retain all statutory rights that cannot be waived (including under applicable U.S. state consumer protection laws and EU/UK consumer law).
11. Limitation of Liability
To the fullest extent permitted by law, M8tcha, Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising from or related to your use of the App or interactions with other users, even if advised of the possibility of such damages.
Our total aggregate liability for any claim arising from these Terms or the App shall not exceed the greater of (a) the amount you paid us for Paid Features in the 12 months preceding the claim, or (b) USD 100. Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the maximum extent permitted by law. This limitation does not apply where prohibited by mandatory consumer protection law (including in the EU/EEA/UK).
12. Indemnification
You agree to indemnify and hold harmless M8tcha, Inc. and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your User Content, or your interactions with other users, to the extent permitted by applicable law.
13. Third-Party Services
The App may contain links to or integrate third-party websites or services (including Apple, Google, Stripe, and SMS providers) not owned or controlled by M8tcha. We are not responsible for the content, privacy practices, or terms of any third-party service. Your use of those services may be subject to their own terms.
14. Changes to the App or Terms
We may modify or discontinue any part of the App at any time. We may update these Terms from time to time; material changes will be notified via in-app notice or email at least 14 days before taking effect where required by law. Continued use after changes take effect constitutes acceptance to the extent permitted by law.
15. Governing Law, Venue & Dispute Resolution
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles, except that: (a) the Federal Arbitration Act may apply to the extent arbitration is later agreed; and (b) if you are a consumer habitually resident in the EU/EEA or UK, you also benefit from any mandatory protections of the law of your country of residence, and may bring proceedings in the courts of your country of residence.
Subject to the consumer exceptions above, you and M8tcha agree that exclusive venue for any dispute arising out of or relating to these Terms or the App will be the state or federal courts located in Delaware, USA, and you consent to personal jurisdiction there.
EU consumers may also use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.
Informal resolution: Before filing a claim, you agree to try to resolve the dispute informally by emailing [email protected] with a brief description of the dispute and your contact information. We will attempt to resolve it in good faith within 30 days.
16. Apple-Required EULA Terms
If you obtained the App from the Apple App Store, the App is a Licensed Application under Apple's Minimum Terms of Developer's End-User License Agreement. These Terms are the EULA for that Licensed Application. The following terms apply and, as between you, M8tcha, and Apple, control over any conflicting terms in these Terms solely with respect to Apple and your use of the Licensed Application on Apple-branded products.
16.1 Acknowledgement
You and M8tcha acknowledge that this EULA is concluded between you and M8tcha only, and not with Apple. M8tcha, not Apple, is solely responsible for the Licensed Application and the content thereof. These Terms do not provide usage rules for the Licensed Application that conflict with the Apple Media Services Terms and Conditions as of the effective date of these Terms, which M8tcha acknowledges it has had the opportunity to review. If any usage rule in these Terms conflicts with the Apple Media Services Terms and Conditions regarding use of the Licensed Application on Apple-branded products, the Apple Media Services Terms and Conditions control.
16.2 Scope of License
The license granted to you for the Licensed Application is limited to a non-transferable license to use the Licensed Application on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the Licensed Application may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.
16.3 Maintenance and Support
M8tcha is solely responsible for providing any maintenance and support services with respect to the Licensed Application, as specified in these Terms or as required under applicable law. You and M8tcha acknowledge that Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the Licensed Application. Direct support requests to [email protected].
16.4 Warranty
M8tcha is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be M8tcha's sole responsibility.
16.5 Product Claims
You and M8tcha acknowledge that M8tcha, not Apple, is responsible for addressing any claims of yours or any third party relating to the Licensed Application or your possession and/or use of that Licensed Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the Licensed Application's use of the HealthKit and HomeKit frameworks (if used). These Terms do not limit M8tcha's liability to you beyond what is permitted by applicable law.
16.6 Intellectual Property Rights
You and M8tcha acknowledge that, in the event of any third-party claim that the Licensed Application or your possession and use of the Licensed Application infringes that third party's intellectual property rights, M8tcha, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
16.7 Legal Compliance
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
16.8 Developer Name, Address, and Contact
Questions, complaints, or claims with respect to the Licensed Application should be directed to:
M8tcha, Inc.
Delaware, United States
Email: [email protected]
16.9 Third-Party Terms of Agreement
You must comply with applicable third-party terms of agreement when using the Licensed Application. For example, you must not violate your wireless data service agreement when using the App, including live audio or video Rooms or other data-intensive features.
16.10 Third-Party Beneficiary
You and M8tcha acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
17. Google Play Terms
If you downloaded the App from Google Play, you also agree to comply with Google Play's applicable terms. To the extent required by Google, Google is a third-party beneficiary of these Terms with respect to your use of the Android version of the App, and these Terms are between you and M8tcha only-not Google-regarding the App's content and operation (except for Google Play Billing transactions governed by Google).
18. Export Controls
You may not use, export, or re-export the App except as authorized by United States law and the laws of the jurisdiction in which you obtained the App. You represent that you are not located in any U.S.-embargoed country and are not a prohibited or restricted party under U.S. law.
19. General
- Entire Agreement: These Terms (including the Apple-required EULA terms), together with our Privacy Policy, Acceptable Use Policy, and Refund Policy, constitute the entire agreement between you and M8tcha regarding the App.
- Severability: If any provision is found unenforceable, the remaining provisions remain in full effect.
- No Waiver: Our failure to enforce any right or provision is not a waiver of that right.
- Assignment: You may not assign these Terms without our consent, except that the Licensed Application may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing as permitted by Apple. We may assign these Terms in connection with a merger, acquisition, financing, or sale of assets.
- Headings: Headings are for convenience only and do not affect interpretation.
